Terms of Service

These terms govern use of the Agent Tomas service, operated by Tomer Cohen Consulting (תומר כהן ייעוץ), Israel.

1. The service

Agent Tomas provides AI agents that manage Instagram engagement on behalf of business clients — reading comments and direct messages, and responding according to rules the client defines.

2. Eligibility

To use the service you must have an Instagram professional account (Business or Creator), be authorized to act on behalf of that account, and be at least 18 years old.

3. Account access

You grant us access through Meta's official Instagram login flow. We access only the permissions you approve. You may revoke access at any time from your Instagram settings, which immediately ends our ability to act on your account.

4. Your responsibilities

• You are responsible for the rules and guidelines you configure. Our agent acts within them.
• You remain responsible for content published on your account, including content our agent publishes under your configuration.
• You must not use the service to send spam, harass anyone, mislead people, or violate Instagram's Community Guidelines or Terms of Use.

5. AI-generated content

Replies are drafted by an AI language model. While the agent follows the rules you set, AI output is not guaranteed to be accurate or appropriate in every case. You should review your agent's activity. We are not liable for the content of AI-generated replies.

6. Platform dependence

The service depends on Meta's Instagram API. If Meta changes, restricts, or discontinues API access, the service may be interrupted or discontinued. We are not responsible for such changes.

7. Availability

We do not guarantee uninterrupted service. The service may be unavailable due to maintenance, technical issues, or platform changes.

8. Limitation of liability

The service is provided as is. To the fullest extent permitted by law, Tomer Cohen Consulting (תומר כהן ייעוץ) is not liable for indirect, incidental, or consequential damages arising from use of the service, including loss of reach, followers, or account access.

9. Termination

Either party may end the engagement at any time. You may revoke access from Instagram at any moment. On termination, we delete your data as described in our Privacy Policy.

10. Governing law

These terms are governed by the laws of the State of Israel.
